Terms and Conditions:

These terms and conditions apply to purchases in the online store www.pinservice.eu, operated by Lucie Hrabovská, Zelnice III, no. 1610, 684 01 Slavkov u Brna, Czech Republic.

Terms and conditions specify the rights and obligations of the seller, which is: Lucie Hrabovská, Pin Service, Zelnice III, no. 1610, 684 01 Slavkov u Brna, Czech Republic and a buyer – customer.
All contractual relations are in accordance with the legal order of the Czech Republic. If the contracting party is a consumer, the relationships not regulated by the Terms and Conditions shall be governed by the Civil Code (No. 89/2012 Coll.) And the Consumer Protection Act (No. 634/1992 Coll.). If the contracting party is not a consumer, the relationships is regulated by the business conditions are governed by the Civil Code (No. 89/2012 Coll.).

The Seller is a person who, when concluding and performing the Contract, acts in the course of his business or other business activities. It is an entrepreneur who, directly or through other entrepreneurs, supplies products or services to the buyer.

 

Buyer:

 

The customer of our online store is the buyer or consumer. A consumer is any person who, outside the framework of his or her business, concludes a contract with or otherwise treats the entrepreneur. A buyer who is not a consumer is an entrepreneur. Entrepreneurs are also considered to be any person who concludes a contract related to their own business, production or other activities, or a person acting on behalf of the entrepreneur.

 

Purchase contract:

 

Should the buyer be a customer, understood as a proposal to conclude a purchase contract is the listing of the goods offered on the seller’s website, whereby the purchase contract is implemented by the purchasing customer sending an order and the acceptance of this order by the seller. The seller shall immediately confirm the recept of the buyer’s order by means of an informational e-mail sent to the specified e-mail address. This confirmation will contain prices for goods, VAT tax, postage and other charges, payment options, sellers address and buyer’s address. Also will be included any other particulars of the Proforma Invoice.

Before sending the order to the seller, the buyer is allowed to check the data entered in the order. The buyer sends the order to the seller by clicking on the "send order" button.
By concluding the purchase agreement, the buyer confirms that he has read and agrees with these terms and conditions.
The consumer is entitled to a discount under certain purchasing conditions. This discount is not fixed and can always be different. The discount is set by the seller based on the ordered quantity of goods and according to his current possibilities.

 

The consumer's right of withdrawal/Complaints Procedure:

 

If the purchase contract is concluded by means of distance communication (in an online store), the consumer has the right to withdraw from the contract within 14 days of receipt of the goods without giving reasons, in accordance with §1829, paragraph 1 of the Civil Code. Withdrawal from the contract must be delivered to the seller in writing or by e-mail within this period of 14 days. In this written notice, the consumer shall state the date of the order, the content of the order, his address and name, the account number or the payment method for the refund.
In the event that the Buyer meets these withdrawal conditions, the Seller shall refund funds to the Buyer, in addition to the amount representing the additional cost of delivery resulting from the Buyer's chosen delivery method, within 14 days of receipt of the withdrawal in the same manner as accepted unless otherwise specified by the buyer. The seller is not obliged to return the received funds to the buyer before the buyer returns the goods or proves that the goods sent.
If the returned goods are damaged, the seller may claim the consumer's right to compensation. In this case, the seller is obliged to prove the damage. In such a case, the seller shall only return the price reduced to the consumer.

 

Protection of personal data:

 

The Seller declares that all personal data is confidential and will only be used to perform the Contract. They will not be otherwise published or used for marketing purposes, except in the case of distribution or payment related to the ordered goods - name, delivery address, telephone. Personal data provided voluntarily by the buyer to the seller in order to fulfill the order and marketing actions of the seller are collected, processed and stored in accordance with applicable laws of the Czech Republic, in particular the Personal Data Protection Act No. 101/2000 Coll. as amended by later amendments and regulations. By concluding the contract, the buyer agrees to the processing and collection of his personal data in the seller's database until his written statement of disagreement sent by letter or e-mail.

 

Payment terms:

  • Prices are given in EUR or US$ you can switch between EUR/USD top right of the page.
  • If you want to pay in other currency, please let us know – leave the message at the end of your order in the note box.
  • Customers in EU: prices are without VAT tax, which is in Czech 21% . If you have a VAT tax number = you are a VAT tax payer, please fill your VAT number. Customers in EU, without VAT tax number, will have to pay the price including the Czech VAT tax 21%.
  • Non-EU customers: your price is final, there is no VAT tax.
  • Proforma Invoice (price quotation): after finish your order, we will send you the Proforma Invoice as soon as possible. The shipping charge will be included.

 

Shipping charge: postage and packing are calculate according to your destination country, customs fees and instance package.

  • Credit card (through the PayPal bank, without any registration)

We most prefer payment by bank transfer.

Customer's account:


Based on the buyer's registration in the online store, the buyer can access his customer account. From his customer account, the buyer can order goods. The buyer can also order goods without registration.
When registering in the customer account and ordering goods, the buyer is obliged to provide correct and truthful information. The Buyer is obliged to update the data entered in the user account upon any change. The data provided by the buyer in the customer account and when ordering goods are considered correct by the seller.
Access to the customer account is secured by a username and password. The buyer is obliged to maintain confidentiality regarding the information necessary to access his customer account. The Seller is not responsible for possible misuse of the customer account by third parties.
The Buyer is not entitled to allow third parties to use the Customer Account.
The seller may cancel the user account, especially if the buyer no longer uses his user account, or if the buyer breaches his obligations under the contract and these terms and conditions.

 

Postage and other charges:

 

The Buyer acknowledges that the total price of the created order is only for the ordered goods. On the basis of the received order, the Seller shall calculate the postage and other fees associated with the order, such as customs or parcel insurance. These fees are determined by the country to which the goods will be dispatched.
The Seller is obliged to notify all such fees to the Buyer in the form of an Proforma Invoice. The purchase contract is therefore concluded after receiving the order confirmation by the buyer with all these particulars.

 

Final Provisions:

All arrangements between the Seller and the Buyer shall be governed by the laws of the Czech Republic. If the relationship established by the purchase contract contains an international element, then the parties agree that the relationship is governed by the law of the Czech Republic. This is without prejudice to the consumer's rights under generally binding legal regulations.
In relation to the Buyer, the Seller is not bound by any codes of conduct within the meaning of § 1826 para. e) of the Civil Code.
All rights to the Seller's website, especially copyright to the content, including page layout, photos, movies, graphics, trademarks, logos, and other content and elements, belong to the Seller. It is forbidden to copy, modify or otherwise use the website or its part without the consent of the seller.
The Seller shall not be liable for errors resulting from interference of third parties in the Internet shop or as a result of its use contrary to its purpose. When using the online store, the buyer may not use procedures that could adversely affect its operation and may not engage in any activity that may allow him or third parties to tamper with or use the software or other components of the online store and use the online store, or parts or software equipment in such a manner as to conflict with its purpose or purpose.
The Buyer hereby assumes the risk of changing circumstances within the meaning of Section 1765 (2) of the Civil Code.
The purchase contract, including the terms and conditions, is archived by the seller in electronic form and is not accessible.
The Seller may change or supplement the wording of the Terms and Conditions. This provision is without prejudice to rights and obligations arising during the effective date of the previous version of the Terms and Conditions.
